Abstract

A la presente investigación se le ha titulado “El derecho de un menor de edad de conservar su apellido, aunque dicha paternidad haya sido impugnada y el derecho constitucional a la identidad”; pues, a través de la presente se ha buscado, a partir del análisis jurisprudencial, sentar algunas bases jurídicas, para que en casos particulares y concretos, nuestros tribunales evalúen si es que es pertinente y acorde con algunos derechos de reconocimiento constitucional, que la impugnación de paternidad, de manera inflexible; termine por eliminar el apellido de aquel niño o niña. Por eso es que en esta investigación, se ha llegado a la siguiente interesante conclusión: “Los fundamentos jurídicos existen para afirmar que un menor de edad conserve su apellido paterno, aunque dicha paternidad haya sido impugnada son el derecho a la identidad, sobre todo desde la óptica de la identidad dinámica; otro de los fundamentos es el derecho al nombre, ya que este no solo define las características externas de una persona, sino que este tiene una función de identificación e individualización de todo ser humano; otro fundamento es el I.S.N, ya que esta regla, principio y derecho pugna siempre por una adecuada y eficaz protección de aquel niño, niña o adolescente; finalmente, esta medida es más acorde con el derecho convencional que resulta ser más tuitivo con el niño, niña o adolescente

The present investigation has been entitled ""The right of a minor to keep his last name, even if said paternity has been challenged and the constitutional right to identity""; Therefore, through this letter, based on the jurisprudential analysis, we have sought to establish some legal bases, so that in particular and concrete cases, our courts can evaluate whether it is pertinent and in accordance with some rights of constitutional recognition, that the challenge of paternity, inflexibly; I ended up eliminating the last name of that boy or girl. That is why in this investigation, the following interesting conclusion has been reached: ""The legal grounds exist to affirm that a minor retains his paternal surname, even if said paternity has been challenged, they are the right to identity, especially since the optics of dynamic identity; Another of the foundations is the right to a name, since this not only defines the external characteristics of a person, but also has a function of identification and individualization of every human being; another foundation is the best interest of said child, since this rule, principle and right always strives for adequate and effective protection of that child or adolescent; finally, this measure is more in line with the conventional law that turns out to be more protective with the boy, girl or adolescent
