Inobservancia de los límites establecidos a la jornada atípica de los trabajadores mineros en la legislación peruana

Abstract

La investigación tiene como objeto el estudio de la adecuada aplicación del régimen atípico en el sector minero puesto que se aprecia que las empresas mineras mediante sus titulares y/o representantes abusan de su calidad de empleadores, siendo necesario para ello regular una ley que limite dicho abuso de poder, tal cual se aprecia en los datos estadísticos señalados por el INEI, los mismos que se apreciarán bajo el desarrollo de la presente investigación, demostrándose así que mediante la creación de dicha ley se elimine la inobservancia de los límites señalados en el artículo Reglamento 9° del TUO de la Ley de Jornada de Trabajo, Horario y Trabajo en Sobretiempo - Decreto Supremo Nº 008-2002-TR, que prescribe “(…) el promedio de horas trabajadas en el ciclo o período correspondiente no podrá exceder los límites máximos previstos por la Ley (…), generando una correcta y justa aplicación del régimen laboral atípico en el sector minero.

The purpose of the research is to study the appropriate application of the atypical regime in the mining sector since it is observed that mining companies through their owners and / or representatives abuse their status as employers, being necessary to regulate a law that limits said abuse of power, as shown in the statistical data indicated by the INEI, which will be appreciated under the development of the present investigation, thus demonstrating that by means of the creation of said law the non-observance of the limits indicated in the article is eliminated Regulation 9 of the TUO of the Law on Working Hours, Hours and Work in Overtime - Supreme Decree No. 008-2002-TR, which prescribes ""(...) the average hours worked in the corresponding cycle or period may not exceed the limits maximums foreseen by the Law (...), generating a correct and fair application of the atypical labor regime in the mining sector.
