La restricción del derecho de la libertad de afiliación política por el procedimiento de desafiliación por causa indebida

Abstract

El presente trabajo de investigación tiene por objetivo general determinar de qué manera la onerosidad del procedimiento administrativo de desafiliación por causa indebida restringe el derecho a libertad de afiliación política. Propósito que se desarrolla según el tipo de investigación descriptiva, arribando a una de las principales conclusiones como es; se restringe el derecho a la participación política respecto a la desafiliación en tanto que para ejercer el derecho a libertad de afiliación política de manera libre, la norma prescribe que se debe cancelar el derecho al trámite cuando existe una afiliación indebida o cuando ha sido sin el consentimiento del ciudadano o ciudadana. Este condicionamiento llega a restringir al derecho de la libertad de afiliación política, puesto que, si el ciudadano no se ha afiliado con su consentimiento, no hay razón del porqué debería pagar por dicha desafiliación. Finalmente, la propuesta del presente trabajo comprende la modificación del art. 127°del Reglamento del Registro de Organizaciones Políticas aprobado por Resolución N° 0049-2017-JNE estableciendo el reembolso del monto pagado por el ciudadano siempre y cuando se haya acreditado lo indebido en la afiliación por la organización. El reembolso estará a cargo de la misma entidad electoral que recaudó el monto para la tramitación de afiliación indebida, en un plazo de 05 días hábiles posterior a la resolución de desafiliación.

This research work has the overall objective to determine how the onerousness of the administrative procedure of disenrollment by undue cause restricts the right to freedom of political affiliation. Purpose that develops according to the type of descriptive research, arriving at one of the main conclusions as it is; restricts the right to political participation in respect of the disaffiliation while to exercise the right to freedom of political affiliation in a free, the standard prescribes that you must cancel the right to process when there is a undue affiliation or when it has been without the consent of the citizen. This conditioning comes to restrict the right to freedom of political affiliation, since, if the citizen has not been affiliated with your consent, there is no reason why should pay for such a disenrollment. Finally, the proposal of this work includes the modification of the art. 127°of regulation of the Registry of Political Organizations approved by Resolution No. 0049-2017-JNE by setting the repayment of the amount paid by the citizen as long as it has been credited as drug abuse in the affiliation by the organization. The refund will be in charge of the same entity which raised the amount election for the processing of undue affiliation, within 05 working days after the resolution of disenrollment.
