Los aspectos determinantes de la teoría de declaración de voluntad como sustento para la declaración de indignidad de un adolescente infractor por conducta antisocial dolosa, en agravio de su progenitor

En nuestro país, la transmisión sucesoria se sustenta en el derecho constitucional
a la herencia de los sucesores, a quienes se les trasmitirá un porcentaje del acervo
patrimonial de su causante. Dicha trasmisión está justificada en los lazos
sanguíneos y el afecto mantenido entre las partes. En ese sentido, como una forma
de sancionar el incumplimiento del respeto a la vida, o integridad de su causante o
sus familiares cercanos, o contra la existencia de su testamento, se instauró la
institución jurídica de la declaración de indignidad.
La declaración de indignidad es una sanción civil a un sucesor desleal a la relación
familiar o de afecto, que será castigado con la exclusión de la herencia por la
comisión de las causales determinadas en el artículo 667°, del Código Civil,
particularmente del inciso 1, referido al homicidio de su causante. No obstante, en
el caso sea un menor de edad el que atente contra la vida de su causante como lo
estipula el inciso 1, del artículo 667°, del CC, se imposibilita la declaración de
indignidad por encontrarse dentro del ámbito de protección del artículo 748°, del
Código Civil.
Contrariamente a la disposición contenida en el artículo 748°, del Código Sustantivo
y el reconocimiento de capacidad actual de los menores de edad, la Teoría de
Declaración de Voluntad estipula que la exteriorización de voluntad se plasma
objetivamente en acciones que reflejan el querer interno, en otros términos, con la
voluntariedad de cometer un delito en agravio de sus padres los menores de edad
reflejan su objetivo. Para el jurista Lohmann Luca de Tena, la voluntariedad es
determinante para el análisis del merecimiento de exclusión de la sucesión.
Asimismo, la Teoría institucional desde la Perspectiva del Niño como Sujeto de
Derecho, propugna la contemplación de los menores de edad como sujetos de

derechos responsables de sus actos con la protección de su libre desarrollo por el
Estado.
Después del estudio de la situación jurídica de la institución de indignidad,
proponemos la posibilidad de eliminar a los menores de edad con capacidad
restringida del ámbito de protección del artículo 748°, del Código Civil. Debido a que
un menor de edad infractor de la ley penal no debe enriquecerse con el acervo
patrimonial de su causante cuando fue este quien le dio muerte, con la salvedad del
respeto a su derecho de alimentos hasta su mayoría de edad para salvaguardar su
integridad y educación. In our country, the inheritance transmission is based on the constitutional right to
inheritance of the successors, to whom a percentage of the patrimonial heritage of
the deceased will be transmitted. Said transmission is justified in the blood ties and
the affection maintained between the parties. In that sense, as a way to punish the
breach of respect for life, or integrity of the deceased or his close relatives, or against
the existence of his will, the legal institution of the declaration of indignity was
established.
The declaration of indignity is a civil sanction for a successor who is unfair to the
family or affection relationship, which will be punished with the exclusion of
inheritance for the commission of the causes determined in article 667 °, of the Civil
Code, particularly subsection 1 , referring to the homicide of the deceased. However,
in the case of a minor who threatens the life of the deceased as stipulated in
paragraph 1, article 667 °, CC, the declaration of indignity is impossible because it
is within the scope of protection of the article 748 °, of the Civil Code.
Contrary to the provision contained in article 748 of the Substantive Code and the
recognition of the current capacity of minors, the Declaration of Will Theory stipulates
that the externalization of will is objectively reflected in actions that reflect the internal
will, in other terms, with the will to commit a crime to the detriment of their parents,
minors reflect their objective. For the jurist Lohmann Luca de Tena, voluntariness is
decisive for the analysis of the merit of exclusion from the succession. Likewise, the
Institutional Theory from the Perspective of the Child as a Subject of Law, advocates
the contemplation of minors as subjects of rights responsible for their actions with
the protection of their free development by the State.

After studying the legal situation of the institution of indignity, we propose the
possibility of eliminating minors with restricted capacity from the scope of protection
of article 748 of the Civil Code. Because a minor offender of the criminal law should
not enrich himself with the patrimonial heritage of his deceased when it was he who
killed him, with the exception of respecting his right to food until his majority to
safeguard his integrity and education.
