La limitación resarcitoria en el numeral B) del art. 14° de la ley N° 27596 referente a la indemnización equivalente a 1 UIT que afronta el propietario o poseedor de un Can en caso de que éste último cause la muerte a otro Can

Abstract

La presente tesis tiene como finalidad realizar un estudio de la Ley N° 27596, Ley que regula el Régimen Jurídico de Canes, así como también de su reglamento aprobado mediante Decreto Supremo N° 006-2002-SA, específicamente pretendemos hacer un análisis respecto al numeral b) del Art. 14° de la presente Ley, referente a la indemnización equivalente a 1 UIT que afronta el dueño o poseedor de un can en caso de que éste último cause la muerte a otro can. De igual forma, en nuestra investigación desarrollaremos el estudio que abarca la Responsabilidad Civil Extracontractual (Art. 1969º y 1970°), especialmente aquella que trata sobre los Daños Causados por Animales (Art. 1979º C.C.), y de acuerdo a ello, dilucidar si el monto indemnizatorio que afronta el dueño o poseedor de un can en caso de que éste último cause la muerte a otro can, monto equivalente a 1 UIT, señalado en el numeral b) del Art. 14º de Ley Nº 27596 (norma de carácter especial), que tiene una especie de valoración tasada legalmente, resulta ser discrepante con el Art. 1985º del Código Civil referente a la indemnización por responsabilidad extracontractual, en la medida de que ésta última tiene mucho más alcance de protección a la víctima en cuanto al resarcimiento de daños causados por animales, a pesar de ser una norma de carácter general, sin embargo, la primera impone un límite de 1 UIT en cuanto a la indemnización, monto que a nuestro parecer es insuficiente. Por último, analizaremos Legislación, Doctrina y Jurisprudencia en el Derecho Comparado concerniente a la indemnización en casos de Responsabilidad Civil por Daños Causados por Animales, a fin de poder identificar diferencias o similitudes con las normas dadas en nuestro país, sobre todo, respecto a los criterios para determinar el pago de una indemnización en caso de que el dueño o poseedor de un can causara la muerte de otro can.

The purpose of this thesis is to carry out a study of Law N ° 27596, Law that regulates the Legal Regime of Dogs, as well as its regulations approved by Supreme Decree N ° 006-2002-SA, specifically we intend to make an analysis regarding the numeral b) of Art. 14 of this Law, referring to the compensation equivalent to 1 UIT that the owner or possessor of a dog faces in the event that the latter causes the death of another dog. Likewise, in our research we will develop the study that covers Non-contractual Civil Liability (Art. 1969º and 1970 °), especially that dealing with Damage Caused by Animals (Art. 1979º CC), and accordingly, elucidate whether the amount of compensation that the owner or keeper of a dog faces in the event that the latter causes the death of another dog, an amount equivalent to 1 UIT, indicated in number b) of Article 14 of Law No. 27596 (special rule ), which has a kind of appraisal legally assessed, turns out to be inconsistent with Art. 1985º of the Civil Code regarding compensation for non-contractual liability, insofar as the latter has much more scope of protection for the victim in terms of compensation of damage caused by animals, despite being a general rule, however, the first imposes a limit of 1 UIT in terms of compensation, an amount that in our opinion is insufficient. Finally, we will analyze Legislation, Doctrine and Jurisprudence in Comparative Law concerning compensation in cases of Civil Liability for Damage Caused by Animals, in order to identify differences or similarities with the regulations given in our country, especially with respect to criteria to determine the payment of compensation in the event that the owner or possessor of one dog caused the death of another dog
