La vulneración del derecho al ambiente por parte de las empresas dedicadas a la producción de material no ferroso en el Perú

Abstract

El presente trabajo de investigación expone una de las principales problemáticas de las relaciones familiares en nuestro ordenamiento jurídico, denominado: “LA GESTACIÓN SUBROGADA GRATUITA Y LA NECESIDAD DE SU REGULACIÓN EN EL ORDENAMIENTO JURÍDICO PERUANO PARA GARANTIZAR LOS DERECHOS DE LAS PARTES”; temática que se viene discutiendo arduamente en la doctrina y jurisprudencia nacional como hemos referido sobre los principales derechos de las partes respecto a la maternidad subrogada, considerando el interés superior del niño. Asimismo, la metodología empleada es del método científico que implicará la observación y descripción de la figura jurídica de la regulación de la aplicación de la gestación subrogada gratuita, sin influir en dicha figura bajo ninguna circunstancia. Por otro lado, expondremos los principales resultados de la importancia de la regulación de la figura jurídica antes referida, para establecer conclusiones idóneas sobre la importante necesidad de su regulación y sus consecuencias legales en nuestro país.

The present research work exposes one of the main problems of family relationships in our legal system, called: ""FREE SURROGERY AND THE NEED FOR ITS REGULATION IN THE PERUVIAN LEGAL ORDER TO GUARANTEE THE RIGHTS OF THE PARTIES""; a subject that has been arduously discussed in the doctrine and national jurisprudence as we have referred to the main rights of the parties regarding surrogacy, considering the best interest of the child. Likewise, the methodology used is of the scientific method which will involve the observation and description of the legal figure of the regulation of the application of free surrogacy, without influencing such figure under any circumstances. On the other hand, we will expose the main results of the importance of the regulation of the aforementioned legal figure, in order to establish suitable conclusions on the important need for its regulation and its legal consequences in our country.
