Protección del derecho a la identidad biológica con la impugnación de paternidad en el Perú, Argentina, Brasil y Costa Rica

Abstract

El interés por abordar la presente investigación, titulada “Protección del derecho a la identidad biológica con la impugnación de paternidad en el Perú, Argentina, Brasil y Costa Rica”, radica en la necesidad de determinar si se protege la identidad biológica del menor, o no, con la impugnación de la paternidad, a merced de lo regulado en los diferentes artículos de las constituciones, de los código civiles, código del niño y de los adolescentes, código de familia así como los diferentes convenios y tratados que protegen y reconocen los derechos con los que debe contar un menor cuyo bienestar es considerado como una prioridad del Estado. La identidad es un derecho humano que comprende derechos correlacionados: el derecho a un nombre propio, a conocer la propia historia filial, al reconocimiento de la personalidad jurídica y a la nacionalidad. Como todos los derechos humanos, el derecho a la identidad se deriva de la dignidad inherente al ser humano, razón por la cual le pertenece a todas las personas sin discriminación, estando obligado el Estado a garantizarlo, mediante la ejecución de todos los medios de los que disponga para hacerlo efectivo A efectos de comprender las implicancias de las variables analizadas – la identidad biológica y la impugnación de paternidad – nos hemos valido de los aportes de la doctrina, la jurisprudencia y los precedentes vinculantes (recopilación documental). Creemos que la importancia de la presente investigación radica en la posibilidad de determinar si se protege el derecho a la identidad biológica con la impugnación de paternidad en las legislaciones de Perú, Argentina, Brasil y Costa Rica, permitiéndonos confirmar o rechazar nuestra hipótesis planteada; y al mismo tiempo, servirá de precedente a futuras investigaciones, a efectos de superar lo hasta aquí logrado.

The interest in addressing this research, entitled “Protection of the right to identity with biological paternity challenge in Peru, Argentina, Brazil and Costa Rica“, Is the need to determine whether the biological identity of the child is protected or not, with the denial of paternity , at the mercy of the regulations in the various articles of the constitution, civil code, child and adolescent, family code and the various conventions and treaties that protect and recognize the rights that should tell a child whose welfare is considered as a State priority. Identity is a human right which includes correlated rights: the right to a name, to meet the subsidiary’s own history, the recognition of legal personality and nationality. Like all human rights, the right to identity is derived from the inherent dignity of the human being, which is why it belongs to all people without discrimination, being forced by the State to guarantee, through the implementation of all means of available to it to make it effective In order to understand the implications of the analyzed variables - the biological identity and paternity challenge - we have made use of the contributions of the doctrine, jurisprudence and binding precedents (documentary collection). We believe that the importance of this research lies in the ability to determine whether the law protects the identity of biological paternity challenge the laws of Peru, Argentina, Brazil and Costa Rica, allowing us to confirm or reject our hypothesis, and at the same time serve as a precedent for future research, in order to overcome the hitherto achieved.
