Nuestro interés por abordar la presente investigación titulada: LA NO APLICACIÓN DE LA SUSPENSIÓN DE LA PENA EN EL DELITO DE OMISIÓN A LA ASISTENCIA FAMILIAR, radica en la necesidad de establecer si resulta conveniente o no suspender la ejecución de la pena en el delito de Omisión a la Asistencia Familiar, en tanto el obligado no esté al día en el pago de las pensiones alimenticias señaladas en el proceso correspondiente.
Con la finalidad de poder comprender las implicancias de las variables analizadas nos hemos valido de los aportes de la doctrina nacional e internacional de diversos autores.
Después de haber desarrollado los diversos capítulos de nuestra investigación concluimos en que no resulta conveniente la aplicación de la suspensión de la ejecución de la pena en el delito de omisión a la asistencia familiar cuando el obligado al momento de emitir sentencia no haya cumplido con el pago de la liquidación de pensiones alimenticias que originaron el proceso, así como cuando no se encuentra al día en el pago de la pensión alimenticia fijada en la sentencia de alimentos. Consideramos que la presente investigación, servirá de precedente a futuras investigaciones, a efectos de superar lo hasta aquí logrado. OF SUSPENDED SENTENCE FOR THE CRIME OF OMISSION FAMILY
care is the need to establish whether it is appropriate or not to suspend the
execution of the sentence for the crime of omission family care, while the
bound is not current in the payment of maintenance outlined in the
corresponding process.
In order to understand the implications of the analyzed variables we have
used the contributions of national and international literature by various
authors.
We are having developed the various chapters of our research we
concluded that it is not appropriate to apply the suspension of the execution
of the sentence for the crime of omission family care when required when
delivering judgment has not complied with the payment the liquidation of
alimony underlying the process and when not to date in the payment of
maintenance determined in the judgment of food. We believe that this
research will serve as a precedent for future research, in order to overcome
the hitherto achieved
