Fortalecimiento de la protección al ambiente y los recursos naturales en la constitución peruana de 1993

Abstract

El presente trabajo de investigación, busca considerar a la naturaleza como “sujeto de derecho”, teniendo en cuenta ya las experiencias de los países de Ecuador y Bolivia, los cuales han considerado en su Carta Magna dicho status a la naturaleza. En tal sentido, con el desarrollo del presente trabajo, se busca ampliar el ámbito del reconocimiento de la naturaleza como sujeto de derecho, la cual tendrá una gran y positiva influencia tanto en el desarrollo del numerus clausus previsto en el artículo 3 de la Constitución, como en el derecho que tiene todo ser humano a vivir en un ambiente adecuado al desarrollo de su vida (según el inciso 22 del artículo 2 del texto constitucional), conforme se precisará más adelante. En esa misma orientación, se considera que el estudio estará incompleto si no se buscan alternativas de solución viables al problema del creciente deterioro del ambiente y de los recursos naturales, una de las cuales sería el concebir el desarrollo de los denominados “impuestos ambientales”, que se detallará oportunamente. Para la presente investigación, se han abordado comentarios referentes a los artículos 2° inciso 22 y 3° de la Constitución Política; asimismo, se ha hecho un breve comentario respecto a las Constituciones de Ecuador y Bolivia, así como de los Tributos Ambientales. Asimismo, para el presente desarrollo se han empleado los métodos hermenéuticos, analíticos, histórico, entre otros; mientras que la entrevista fue la técnica empleada para el desarrollo de la presente investigación.

The present research seeks to consider nature as “subject of law“, and considering the experiences of the countries of Ecuador and Bolivia, which have been considered in this status Constitution to nature. In this regard, the development of this work, we seek to extend the scope of recognition of nature as a legal entity, which will have a great and positive impact both on the development of numerous clauses under Article 3 of the Constitution, as in the right of every human being to live in a suitable environment for the development of their life (according to paragraph 22 of Article 2 of the Constitution), as will be specified later. In the same direction, it is considered that the study will be incomplete without seek viable alternative solutions to the problem of increasing deterioration of the environment and natural resources, one of which would be to conceive the development of socalled “environmental taxes“, which will be detailed in due course. For the present investigation, we have addressed comments concerning Articles 2, subsection 22 and 3 of the Constitution, also has made a short comment regarding the constitutions of Ecuador and Bolivia, as well as of Environmental Taxes. Also, for this development have been used hermeneutical methods, analytical, historical, among others, while the interview was the technique used for the development of this research
