Tutela jurisdiccional de las víctimas de violencia familiar y el control difuso de convencionalidad

Abstract

El presente trabajo de investigación; tiene por finalidad estudiar el problema sobre la aplicación del control de convencionalidad por los órganos jurisdiccionales en materia de Familia esto en aras del el fortalecimiento del derecho a la tutela jurisdiccional efectiva de la víctima de violencia familiar, teniendo por hipótesis, la acción positiva en el fortalecimiento del derecho a la tutela debida cuenta al uso del desarrollo jurisprudencial tanto de nuestro Tribunal Constitucional como también de nuestra Corte Interamericana de Derechos Humanos. Es a tal fin, que se opta por metodología el estudio de la doctrina del control difuso de convencionalidad, jurisprudencia interamericana, entrevistas y encuestas a los involucrados dentro del proceso judicial de violencia familiar, esto es a profesionales del Derecho, tanto Jueces, Fiscales, Defensor del Pueblo y abogados litigantes. Llegándose a destacar unas de las principales conclusiones; el fortalecimiento de la tutela jurisdiccional efectiva sobre violencia familiar debe tener estándares de observaciones interamericanos, toda vez que los derechos humanos de una víctima no únicamente acaban en la ley, ni en constitución sino en el dinamismo jurisprudencial de la corte interamericana de derechos humanos.
