La soberanía internacional y su influencia en la regulación del estado de emergencia en la Constitución Política del Perú de 1993

Abstract

La presente Tesis, intitulada: “La Soberanía Internacional y su influencia en la regulación del estado de emergencia en la Constitución Política del Perú de 1993” tiene como objetivo general: Determinar cómo influye la Soberanía Internacional en la regulación del Estado de Emergencia prescrito en el Art. 137º inc 1 de la Constitución Política del Perú de 1993, para ello se utilizó métodos empíricos y teóricos, mediante la recopilación de información en libros, códigos, leyes, a fin de determinar y analizar el criterio de expertos sobre la influencia del concepto de Soberanía Internacional en la regulación del estado de emergencia en la Constitución Política del Perú de 1993. Así mismo se empleó la técnica del análisis documental y la técnica del grupo de discusión. La pertinencia del grupo de discusión se fundamentó en la necesidad de recolectar información relevante de especialistas en el tema materia de investigación, llegándose a la conclusión que la Soberanía Internacional como elemento fundamental del nuevo constitucionalismo influye en la regulación del Estado de Emergencia en la Constitución Política del Perú de 1993, al permitir que se pueda ceder soberanía a organismos internacionales a fin de que cuenten con poderes supranacionales, en las luchas contra problemas de carácter mundial que garantice los derechos fundamentales universales. Así mismo que existe la posibilidad de crear un modelo común de regulación del estado de emergencia, que sea posible hacer frente ante una situación imprevista o ante una contingencia y como tal se debe tener medidas debidamente definidas, sobre todo en la asignación de responsabilidades a nivel de funcionarios para dictaminar medidas urgentes ante un contexto adverso y excepcional

This Thesis, which we have titled: ""International Sovereignty and its influence on the regulation of the state of emergency in the Political Constitution of Peru of 1993"" has as its general objective: To determine how International Sovereignty influences the reform of the State of Emergency regulated in Article 137 inc 1 of the Political Constitution of Peru of 1993, for this purpose empirical and theoretical methods were used, through the collection of information in books, codes, laws, in order to determine and analyze the criteria of experts on the influence of the concept of International Sovereignty in the regulation of the state of emergency in the Political Constitution of the Peru 1993. Likewise, the technique of documentary analysis, the technique of the discussion group and the interview were used. The relevance of the discussion group was based on the need to collect relevant information from specialists in the field of research, reaching the conclusion that International Sovereignty as a fundamental element of the new constitutionalism influences the regulation of State of Emergency in the Political Constitution of Peru of 1993, by allowing international organizations to be endowed with sovereignty so that they have supranational powers, in the struggles against problems of a global nature that guarantee universal fundamental rights. Likewise, there is the possibility of creating a common model of regulation of the state of emergency, which is possible dealing with an unforeseen situation or contingency and as such must have duly defined measures, especially in the allocation of responsibilities at the level of officials to dictate urgent measures in an adverse and exceptional context
