Necesidad de articular entidades tutelares con el fin de dotar de mayor eficacia jurídica al art. 49 de la Ley nro 29973 en el sector minero

Abstract

La Tesis que hemos denominado “Necesidad de articular entidades tutelares con el fin de dotar de mayor eficacia jurídica al Art. 49 de la Ley Nro. 29973 en el sector minero”, se orienta a determinar de qué manera se dotará de mayor eficacia a la norma sobre la cuota de empleo a personas discapacitadas señaladas en el art. 49 ° de la Ley General de la Persona con Discapacidad, Nro. 29973, en el sector minero.

En este sentido, la formulación de nuestro Problema fue el siguiente: ¿DE QUÉ MANERA SE DOTARÁ DE MAYOR EFICACIA A LA NORMA SOBRE LA CUOTA DE EMPLEO A PERSONAS DISCAPACITADAS SEÑALADO EN EL ART. 49° DE LA LEY GENERAL DE LA PERSONA CON DISCAPACIDAD, NRO. 29973,EN EL SECTOR MINERO?

La hipótesis que planteamos es la siguiente: “Se dotará de mayor eficacia a la norma sobre la cuota de empleo a personas discapacitadas señaladas en el art. 49 ° de la Ley General de la Persona con Discapacidad, Nro. 29973, en el sector minero; promoviendo la articulación de las diversas entidades tutelares de los discapacitados, pues de esta forma se coordinará una efectiva promoción y fiscalización a nivel de empleadores y potenciales trabajadores con el fin de asegurar el cumplimiento de la ley”.

En virtud de los diversos métodos de aplicación lógica y jurídica, hemos logrado concluir que la mejor forma de dotar de mayor eficacia a la norma sobre la cuota de empleo para las personas con discapacidad señalada en el Art. 49 de la Ley General de la Persona con Discapacidad, en el sector minero, es promoviendo la articulación de las diversas entidades tutelares de los discapacitados, pues de esta forma se coordinará una efectiva promoción y fiscalización a nivel de empleadores y potenciales trabajadores con el fin de asegurar el cumplimiento de la ley y favoreciendo a sus destinatarios

Regarding the statement of the hypothesis, we have formulated the following: “The rule on the quota of employment for disabled persons indicated in art. 49 of the General Law of Persons with Disabilities, No. 29973, in the mining sector; promoting the articulation of the various guardianship entities of the disabled, because in this way an effective promotion and supervision will be coordinated at the level of employers and potential workers in order to ensure compliance with the law. “

In application of the various logical and legal methods, including methods of interpretation, hermeneutics, deductive and synthetic, it was concluded that the best way to provide greater effectiveness to the rule on the quota of employment for persons with disabilities indicated in Art. 49 of the General Law of Persons with Disabilities, in the mining sector, is promoting the articulation of the various tutelary entities of the disabled, as this will coordinate an effective promotion and control at the level of employers and potential workers in order to ensure compliance with the law and favoring its recipients.
