El incumplimiento del mandato judicial de régimen de visitas

Abstract

La tesis establece como objetivo general, determinar si el incumplimiento del mandato judicial del régimen de visitas por parte del padre o la madre quien mantiene la custodia del menor, genera afectación en el desarrollo del mismo, y en el derecho que posee para relacionarse con ambos padres. El primer capítulo de la investigación está enfocado principalmente en el planteamiento del problema dentro de nuestra realidad jurídica y social, así como los antecedentes existentes ante esta problemática, el segundo capítulo abarca el marco teórico el mismo que se encuentra dividido en cuatro subcapítulos, el primer subcapítulo está orientado a la familia, analizando su origen, así como las funciones que desempeñan dentro de nuestra sociedad, el segundo subcapítulo desarrolla el tema de la patria potestad así como la capacidad jurídica que tiene una persona para ejercerla dentro de nuestro sistema jurídico. El subcapítulo tercero analiza el tema del interés superior del niño a partir de las bases normativas que la sostienen, el subcapítulo cuarto está orientado al régimen de visitas, el cual es analizado a partir de su fundamento legal y su regulación en nuestro marco normativo, de igual manera el tribunal constitucional se manifiesta en relación al daño generado al menor ante su incumplimiento para posteriormente y de una manera más analítica conocer las distintas medidas que se podrían aplicar en este tipo de situaciones. El capítulo tercero abarca los materiales y métodos utilizados, así como el procedimiento para obtener fuentes de información relacionadas al tema de investigación, finalmente en el capítulo cuarto se establecen las conclusiones siendo la principal medida, la aplicación de sanciones pecuniarias orientadas a garantizaran la continuación de la relación paterno filial con el menor.

The third subchapter analyzes the issue of the best interests of the child from the normative bases that support it, the fourth subchapter is oriented to the visiting regime, which is analyzed based on its legal basis and its regulation in our regulatory framework, In the same way, the constitutional court manifests itself in relation to the harm generated to the minor in the event of non-compliance, and later, and in a more analytical way, to know the different measures that could be applied in this type of situation. The third chapter covers the materials and methods used, as well as the procedure to obtain sources of information related to the research topic. Finally, the fourth chapter establishes the conclusions, the main measure being the application of pecuniary sanctions aimed at guaranteeing the continuation of the filial parental relationship with the minor.
