Mecanismos jurídicos que garantizan la inviolabilidad de la compensación a las remuneraciones en el sistema financiero peruano

Abstract

El presente trabajo de tesis, tiene como título “MECANISMOS JURÍDICOS QUE GARANTIZAN LA INVIOLABILIDAD DE LA COMPENSACIÓN A LAS REMUNERACIONES EN EL SISTEMA FINANCIERO PERUANO”, en el que se realizó un estudio sobre la aplicación de la compensación bancaria y la necesidad de establecer mecanismos que garanticen su inviolabilidad, acorde a una interpretación sistemática de las normas civiles, bancarias y a fines complementado con la jurisprudencia que las desarrolla. El problema planteado en la investigación es: ¿Resulta necesario determinar los mecanismos legales orientados a establecer límites a la facultad de los bancos a compensar sus acreencias con las cuentas de remuneraciones de sus clientes en el Perú? La hipótesis se encuentra planteada de la siguiente manera: Los mecanismos jurídicos que garantizan la inviolabilidad de la compensación a las remuneraciones en el sistema financiero peruano es: el cumplimiento irrestricto de los preceptos legales regulados en el ordenamiento jurídico peruano en materia civil y bancario que son de carácter imperativo, fomentando un precedente que sea vinculante en la jurisprudencia nacional y así evitar que se afecte el derecho de tener una remuneración que salvaguarde su bienestar y el de su familia. La investigación según su fin es aplicada, según su alcance es correlacional o causal y de acuerdo al diseño de contrastación es no experimental o descriptiva. Para la elaboración del presente estudio, se utilizó, índice de datos, análisis bibliográfico y entrevistas a especialistas de derecho civil, bancario y afines. Para recopilar información se utilizaron libros, revistas y páginas web especializadas. Como resultado de la investigación se realizó una propuesta legislativa que conlleve a evitar el inicio de procesos administrativos y judiciales, protegiendo de esta manera la intangibilidad de las remuneraciones.

The present thesis is entitled ““LEGAL MECHANISMS THAT GUARANTEE THE INVIOLABILITY OF THE COMPENSATION OF REMUNERATION IN THE PERUVIAN FINANCIAL SYSTEM““, in which a study was made on the application of bank compensation and the need to establish mechanisms that guarantee its inviolability, according to a systematic interpretation of the civil and banking regulations, complemented with the jurisprudence that develops them. The problem posed in the research is: Is it necessary to determine the legal mechanisms aimed at establishing limits to the power of banks to offset their claims with the remuneration accounts of their clients in Peru? The hypothesis is stated as follows: The legal mechanisms that guarantee the inviolability of compensation to remunerations in the Peruvian financial system is: the unrestricted compliance of the legal precepts regulated in the Peruvian law system in civil and banking matters that are of an imperative nature, promoting a precedent that is binding in the national jurisprudence and thus avoid affecting the right to have a remuneration that safeguards their welfare and that of their family. According to its purpose, the research is applied, according to its scope it is correlational or causal and according to the contrast design it is non-experimental or descriptive. For the elaboration of this study, a data index, bibliographic analysis and interviews to specialists in civil law, banking and related areas were used. Books, magazines and specialized web pages were used to gather information. As a result of the research, a legislative proposal was made to avoid the initiation of administrative and judicial proceedings, thus protecting the intangibility of remunerations
