La ejecución de audiencias en el proceso ordinario laboral bajo el contexto de pandemia Covid- 19 y el acceso a la tutela jurisdiccional efectiva

Abstract

El presente informe de tesis, establece como objetivo general determinar de qué manera la Ejecución de las Audiencias en el Proceso Ordinario Laboral en el contexto de pandemia COVID- 19 garantiza el acceso a la Tutela Jurisdiccional Efectiva en los Juzgados de la Corte Superior de Justicia de La Libertad en el año 2021. La investigación fue básica, con un diseño correlacional. El presente informe no cuenta con hipótesis porque se ha realizado bajo el enfoque cualitativo, por ende, no se ha procedido a formular hipótesis, dado que bajo este enfoque no se persigue la comprobación de la misma. Respecto al desarrollo del presente informe, se tomó a bien investigar el impacto del COVID-19 a consecuencia de la pandemia, debido a que, el Poder Judicial se ha visto obligado a ingresar aceleradamente a una nueva fase de virtualización que permita la continuación de los procesos judiciales y con ello alcanzar su finalidad: la tutela jurisdiccional efectiva. Es por ello que, para el restablecimiento de la actividad jurisdiccional, así como de la permanencia del virus COVID-19 en nuestro medio, resulta necesario que todos los actores del sistema de administración de justicia nos adaptemos al escenario actual, ofreciendo el uso de las tecnologías de la información y comunicación una herramienta útil para reducir los riesgos de contagio del temible virus. Finalmente, la conclusión que se ha arribado es que la Ejecución de las Audiencias en el Proceso Ordinario Laboral en el contexto de pandemia COVID-19 garantiza de manera positiva el acceso a la Tutela Jurisdiccional Efectiva en los Juzgados de la Corte Superior de Justicia de La Libertad en el año 2021.

The general objective of this thesis report is to determine how the Execution of Hearings in the Ordinary Labor Process in the context of the COVID-19 pandemic guarantees access to Effective Jurisdictional Protection in the Courts of the Superior Court of Justice of La Libertad in 2021. The research was basic, with a correlational design. This report does not have hypotheses because it has been carried out under the qualitative approach, therefore, no hypothesis has been formulated, since this approach does not seek to verify it. Regarding the development of this report, it was decided to investigate the impact of COVID- 19 as a result of the pandemic, due to the fact that the Judiciary has been forced to rapidly enter a new phase of virtualization that allows the continuation of judicial processes and thus achieve its purpose: effective jurisdictional protection. That is why, for the reestablishment of jurisdictional activity, as well as the permanence of the COVID-19 virus in our environment, it is necessary for all actors in the justice administration system to adapt to the current scenario, offering the use of information and communication technologies a useful tool to reduce the risks of contagion of the dreaded virus. Finally, the conclusion reached is that the Execution of Hearings in the Ordinary Labor Process in the context of the COVID-19 pandemic positively guarantees access to Effective Jurisdictional Protection in the Courts of the Superior Court of Justice of La Libertad in 2021.
