El desuso de cheques especiales y la vigencia formal de su regulación normativa

Abstract

El presente estudio comprende el análisis de la Ley N° 27287, Ley de Títulos Valores y concretamente las disposiciones relacionadas con el “Cheque”, título valor que como “instrumento de pago” evolucionó conjuntamente con las transacciones bancarias de depósito de dinero, y específicamente respecto a la regulación de los Cheques especiales en que se advierte una paralización en su uso, en su empleo por múltiples factores como el comercio electrónico e incluso por la innovación de las operaciones bancarias que han sabido adecuarse a las actuales circunstancias que el mundo globalizado exige y ante la creciente demanda de títulos valores mobiliarios, que no necesariamente están relacionados con el uso de los cheques especiales que requieren de un soporte físico como el Cheque cruzado, Cheque para Abono en Cuenta, Cheque Certificado, Cheque Giro, Cheque Garantizado y el Cheque de Viajero; de ahí la exigencia de analizar si su desuso incide en la vigencia formal de su regulación normativa, por ello se propuso como problema: ¿Qué cheques especiales han devenido en desuso, incidiendo en la vigencia formal de su regulación normativa? En la ejecución del presente estudio, se empleó métodos generales como el método científico y métodos específicos en la recopilación y análisis de la información doctrinaria que respalda y sustenta los resultados que se postulan, así como se aplicaron técnicas e instrumentos de investigación, cuyos resultados fundamentan también las conclusiones a las que se arriban y refuerzan nuestra posición. Los resultados obtenidos fueron ampliamente discutidos y claramente respaldan nuestra postura expuesta con relación a que los cheques especiales que han devenido en desuso, inciden en la vigencia formal de su regulación normativa; al no aplicarse sus disposiciones que los regulan, son: el Cheque cruzado, Cheque para abono en cuenta, Cheque Certificado, Cheque giro, Cheque garantizado y el Cheque de viajero. 6 Finalmente es de precisar que el presente estudio no comprende la validez u aplicabilidad de la norma jurídica que regula a los cheques especiales, sino está enfocada respecto a su vigencia por su desuso normativo; es decir el dejar de usar las disposiciones de la norma que sigue formalmente vigente pero que sus disposiciones no se aplican. De otro lado; el estudio comprende conclusiones relacionadas con el quehacer en la práctica jurídica vinculada al análisis de las cualidades formales de las normas jurídicas, esto es el estudio de su validez, vigencia y aplicabilidad, concretamente con los cheques especiales

In the execution of this study, general methods such as the scientific method and specific methods were used in the collection and analysis of the doctrinal information that supports and supports the results that are postulated, as well as research techniques and instruments were applied, whose results also support the conclusions reached and reinforce our proposal. The results obtained were widely discussedand clearly support our position stated in relation to the fact that the special cheques that have become obsolete, affecting the formal validity of their normative regulation; since their provisions regulating them are not applied, they are: the crossed cheque, cheques for credit into account, certified cheque, Money Cheque, Guaranteed Check and Traveler's Check. Finally, it should be noted that this study does not include the validity or applicability of the legal norm that regulates special checks, but is focused on its validity due to its normative disuse; that is, the Stop using the provisions of the rule that remains formally in force but that its provisions do not apply. 8 On the other hand; The study includes conclusions and proposes legislative suggestions in order to contribute to the constant work of the law in relation to the analysis of the formal qualities of legal norms, that is, the study of their validity, validity and applicability
