Parámetros diferenciadores entre procesos de restitución internacional de menores y tenencia

Abstract

La presente investigación tiene como objetivo principal establecer los Parámetros diferenciadores entre los Procesos de Restitución Internacional de Menores con los Procesos de Tenencia, a fin de poder acelerar y brindar el adecuado trámite a los pedidos de Restitución de Menores. Es por ello que para cumplir con el propósito de la investigación, se estudiará de todo lo relacionado al PROCESO DE RESTITUCIÓN DE MENORES y PROCESO DE TENENCIA, lo cual facilitará y ayudará a establecer la diferenciación entre ambos procesos jurídicos, pero siempre salvaguardando el Principio del Interés Superior del Niño, conllevando a ello acelerar el proceso y haciéndose respetar plazos establecidos en las Convenciones que han sido ratificadas con el Perú (Convenio Internacional de la Haya sobre Aspectos Civiles de la Sust5accion y la Convención Interamericana sobre Restitución Internacional).

The main objective of this research is to establish the differentiating Parameters between the Processes of International Restitution of Minors and the Tenure Processes, in order to accelerate and provide the appropriate procedure for the requests for Restitution of Minors. That is why to fulfill the purpose of the investigation, everything related to the PROCESS OF CHILD RESTITUTION and TENURE PROCESS will be studied, which will facilitate and help to establish the differentiation between both legal processes, but always safeguarding the Principle of the Higher Interest of the Child, leading to it accelerating the process and respecting deadlines established in the Conventions that have been ratified with Peru (International Convention of the Hague on Civil Aspects of the Substitution and the Inter-American Convention on International Restitution).
