El secuestro conservativo y el aseguramiento de las obligaciones contenidas en los títulos valores, en vía causal

Abstract

El presente trabajo de investigación recoge la problemática respecto a la regulación del secuestro conservativo, a fin de asegurar las obligaciones de dar suma de dinero contenidas en títulos valores, que serán tramitados en la vía causal (sumarísimo, abreviado y de conocimiento); debido a que el segundo párrafo del artículo 643 del Código Procesal Civil, permite concederlo solo cuando se trate de títulos ejecutivos de naturaleza judicial o extrajudicial, que se tramitan en la vía que corresponde a los procesos únicos de ejecución. Es decir el Secuestro Conservativo es exclusivo de la vía ejecutiva, lo cual va a dar lugar a que la ejecución de las sentencias que se expidan en esta vía, se encuentren aseguradas, lo mismo no puede afirmarse de los procesos que se tramitan en la vía causal; luego se enuncia el problema que es respondida por la hipótesis, desmembrada en sus respectivas variables es decir por la variable dependiente e independiente, se constituye el objetivo general así como los objetivos específicos, se describe el tipo de investigación, el método, técnica, instrumentos de investigación, diseño de contrastación de la hipótesis, táctica de recolección de información, diseño de procesamiento y presentación de datos, todo ello constituye el capítulo primero.
