Medida legal a implementar frente a la contaminación ambiental generada por residuos sólidos en la Municipalidad Provincial de Trujillo

Abstract

El presente trabajo de investigación denominado “Medida legal a implementar frente a la contaminación ambiental generada por residuos sólidos en la Municipalidad Provincial de Trujillo”, tiene como objetivo general determinar como la Municipalidad Provincial de Trujillo garantiza el derecho a gozar de un ambiente equilibrado y adecuado al desarrollo de la vida de los ciudadanos señalado en el artículo 2 inciso 22 de la Constitución Política del Perú frente a la contaminación generada por residuos sólidos, para tal fin, se realizó un análisis doctrinario y normativo sobre el tema de residuos sólidos y se estableció los alcances del derecho a gozar de un ambiente equilibrado y adecuado al desarrollo de la vida. Con la investigación realizada se pretende garantizar el derecho a gozar de un ambiente equilibrado y adecuado al desarrollo de la vida de los pobladores de la ciudad de Trujillo debido a que la contaminación ambiental generada por residuos sólidos afecta directamente este derecho, los demás derechos conexos y el ambiente mismo, esto en vista que el Servicio de Gestión Ambiental de Trujillo – SEGAT, no viene cumpliendo a cabalidad con la gestión integral de residuos sólidos; por ello se propone la creación e implementación de una Gerencia del Ambiente en la Municipalidad Provincial de Trujillo que garantice el derecho a gozar de un ambiente equilibrado y adecuado al desarrollo de la vida tal como lo contempla la Constitución Política del Perú.

The present study called “Legal Measure to be Implemented Against Enviromental Pollution Generated by Solid Waste on Trujillo’s City Hall”, has as a general objective determine how the City Hall of Trujillo can guarantee the right to enjoy of a balanced enviroment and the correct development of the citizens lives pointed out on the section 2 subsection 22 of the Political Constitution of Perú against the pollution generated by solid waste, to achieve that, it has been made a doctrinal and normative analisis about the solid waste issue and it was stablished the scope of the right to enjoy of a balanced and suitable enviroment for the development of life. With the research done it is intended to guarantee the right to enjoy of a balanced and suitable enviroment for the development of Trujillo’s citizens lives due to an enviromental pollution generated by solid waste directly affects this right, other related rights and the enviroment itself, this in view that the Enviromental Management Service of Trujillo – EMST, is not fully complying with the integral management of solid waste; that is why it is put forward the creation and implementation of an Enviromental Management in Trujillo City Hall that guarantee the right to enjoyo f a balanced and suitable enviroment for the development of life as contemplated by the Political Constitution of Perú.
