Delimitación de parámetros aplicativos en la vacancia presidencial por permanente incapacidad moral y la incertidumbre jurídico política en el Perú

Abstract

La presente tesis ha sido titulada Delimitación de parámetros aplicativos en la vacancia presidencial por permanente incapacidad moral y la incertidumbre jurídico política en el Perú, la cual ha puesto sobre la palestra un enorme problema político jurídico que parece de nunca acabar; por ello se ha planteado como pregunta de investigación: ¿De qué manera se eliminaría la incertidumbre jurídico-política sobre la vacancia presidencial por permanente incapacidad moral? Así, y teniendo en cuenta la pregunta de investigación, se ha planteado como objetivo general de investigación: Determinar de qué manera se eliminaría la incertidumbre jurídico-política sobre la vacancia presidencial por permanente incapacidad moral. Finalmente y después de haber revisado autorizada dogmática y de haber recopilado la opinión de autorizados especialistas en la materia, se concluyó de manera general: La causal de vacancia presidencial por permanente incapacidad moral posee un contenido subjetivo, abierto y atípico, la misma que está propensa a interpretaciones diversas y hasta contradictorias; en ese mismo sentido se ha podido determinar que el bien jurídico protegido por esta figura es la idoneidad del ejercicio del cargo presidencial; por ello es que, ha quedado demostrado que la manera en que se eliminaría la incertidumbre jurídico-política de la causal ya mencionada sería a través de las regulación legislativa expresa de parámetros para la aplicación de esta causal

This thesis has been titled Delimitation of application parameters in the presidential vacancy due to permanent moral incapacity and legal-political uncertainty in Peru, which has brought to the fore an enormous political-legal problem that seems to never end; For this reason, it has been posed as a research question: How would the legal-political uncertainty regarding presidential vacancies due to permanent moral incapacity be eliminated? Thus, and taking into account the research question, the general research objective has been proposed: Determine how the legal-political uncertainty regarding presidential vacancies due to permanent moral incapacity would be eliminated. Finally, and after having reviewed authorized dogmatic information and having compiled the opinion of authorized specialists in the matter, it was concluded in a general way: The cause of presidential vacancy due to permanent moral incapacity has a subjective, open and atypical content, the same that is prone to diverse and even contradictory interpretations; In that same sense, it has been determined that the legal asset protected by this figure is the suitability of the exercise of the presidential office; For this reason, it has been demonstrated that the way in which the legal-political uncertainty of the aforementioned cause would be eliminated would be through express legislative regulation of parameters for the application of this cause
