Observancia obligatoria del contexto y circunstancias en los casos de tensión entre el derecho al Honor y la Libertad de Expresión en el Perú

Abstract

El presente trabajo de investigación tuvo por objetivo analizar qué otros criterios deberán ser tomados en cuenta para resolver de forma adecuada la tensión entre el derecho al honor y el derecho a la libertad de expresión en el Perú; para eso se usó una metodología mixta, básica, descriptiva y explicativa. La población de estudio estuvo conformada por abogados especializados en derecho constitucional, de los cuales se ha seleccionado 9 como muestra de investigación; a los cuales se les aplicó la técnica de la entrevista implementada mediante el instrumento de la guía de entrevista. Los resultados reconocen la importancia de proteger tanto el derecho al honor como la libertad de expresión, pero también se señala la necesidad de establecer límites claros y garantizar una aplicación efectiva de la ley para evitar abusos. Por lo tanto, se concluyó la necesidad de proteger ambos derechos de manera equilibrada, reconociendo la importancia de garantizar la libertad de expresión sin comprometer la dignidad y el honor de las personas. Por otro lado, algunos señalan la complejidad inherente a encontrar este equilibrio en la práctica, lo que sugiere la necesidad de un análisis más profundo y contextualizado.

The objective of this research work was to analyze what other criteria should be taken into account to adequately resolve the tension between the right to honor and the right to freedom of expression in Peru; For this, a mixed, basic, descriptive and explanatory methodology was used. The study population was made up of lawyers specialized in constitutional law, of which 9 have been selected as a research sample; to whom the interview technique implemented through the interview guide instrument was applied. The results recognized the importance of protecting both the right to honor and freedom of expression, but also pointed out the need to establish clear limits and guarantee effective application of the law to avoid abuses. Therefore, the need to protect both rights in a balanced manner was concluded, recognizing the importance of guaranteeing freedom of expression without compromising the dignity and honor of people. On the other hand, some point out the complexity inherent in finding this balance in practice, suggesting the need for a deeper and more contextualized analysis
