El injusto de la organización criminal: Hacia su fundamentación como injusto de los delitos de organización

Abstract

Esta tesis fundamenta una concepción de injusto de organización criminal como injusto de los delitos de organización. Por ello desarrolla cuatro sub capítulos que componen el marco teórico: En el primero, se analiza lo que la doctrina ha desarrollado respecto a estos delitos; su naturaleza, su clase como tipo penal, su función político-criminal y, especialmente, la estructura típica, a fin de identificar el contexto de la problemática. En el segundo, se desarrolla y explica la legitimación de la existencia de los delitos de organización, haciendo mención al bien jurídico tutelado y al propio fenómeno del crimen organizado, como factores determinantes para respaldar su incriminación misma. En el tercero, se analiza las posturas que han propuesto algunos especialistas respecto al injusto de la organización criminal, las cuales se comenta y crítica con la finalidad de señalar sus aciertos y desaciertos. En el último subcapítulo, se concretiza la postura de esta tesis, proponiendo una postura que permite entender la naturaleza sistémica de la organización criminal y, a partir de ello, explica cómo debe repercutir dicha concepción en la interpretación de la estructura típica de los delitos de organización

This thesis bases a conception of the injustice of criminal organization as the injustice of organized crimes. For this reason, it develops four sub-chapters that make up the theoretical framework: In the first, what the doctrine has developed regarding these crimes is analyzed; their nature, their class as a criminal type, their political-criminal function and, especially, the typical structure, in order to identify the context of the problem. In the second, the legitimization of the existence of organized crimes is developed and explained, mentioning the protected legal asset and the phenomenon of organized crime itself, as determining factors to support its incrimination. In the third, the positions that some specialists have proposed regarding the injustice of criminal organization are analyzed, which are commented and criticized with the purpose of pointing out their successes and failures. In the last subchapter, the position of this thesis is specified, proposing a position that allows us to understand the systemic nature of criminal organization and, based on this, explains how this conception should affect the interpretation of the typical structure of organized crimes
