Efectos de las contrataciones directas aplicadas en el régimen de excepción: estado de emergencia; Municipalidad Provincial de Trujillo según la Contraloría General de la República; período marzo- junio 2020

Abstract

La investigación tiene como objetivo principal: Describir los efectos de las contrataciones directas aplicadas durante el régimen de excepción de estado de emergencia sanitaria, en la Municipalidad Provincial de Trujillo según La Contraloría General de la República; en el periodo de marzo a junio del año 2020. Es un estudio de nivel descriptivo, enfoque cualitativo, finalidad básica y de diseño no experimental y transversal. La información se recopiló de fuentes documentales conformada por cinco informes de control específico posterior hechos por la Contraloría General de la República. Para recoger los datos se utilizó una “Guía de Observación”; la observación y el análisis documental. De acuerdo a los resultados, sobre cinco contratos examinados, las conclusiones son: en cuatro de cinco, el objeto de adquisición fueron canastas básicas familiares; en tres, los sujetos beneficiarios son personal municipal; el perjuicio económico total asciende a S/ 598, 175.90; las normas transgredidas comprenden, La Ley de Contrataciones del Estado y su reglamento; Ley General de Procedimientos Administrativos; El Decreto Legislativo del Sistema Nacional del Presupuesto del Año Fiscal 2020; Ley Marco del Empleo Público. Resoluciones Directorales y Directivas, expedidas por el Ministerio de Economía y Finanzas; Resolución Ministerial referida al MINSA y Especificaciones Técnicas para la Adquisición de Pruebas Rápidas para la Detección Temprana de la Enfermedad Covid 19; también, La Ley Orgánica de Municipalidades; Reglamento de Organización y Funciones de la MPT; Directiva General para Formulación de Requerimientos de Contrataciones a través de Procedimientos de Selección de la Municipalidad de Trujillo, entre otros; los infractores desempeñaban funciones de alcaldía, gerencias, sub gerencias, responsable del almacén; entre las conductas infractoras algunas son por acción, otras por omisión; las responsabilidades presuntas son de tipo penal, civil y administrativa; finalmente, las recomendaciones están dirigidas al Procurador Público para iniciar las acciones legales.

The main objective of the research is to describe the effects of direct contracts applied during the state of health emergency exception regime, in the Provincial Municipality of Trujillo according to the Comptroller General of the Republic; in the period from March to June 2020. It is a descriptive level study, qualitative approach, basic purpose and non-experimental and transversal design. The information was collected from documentary sources made up of five specific reports of subsequent specific control made by the Comptroller General of the Republic. To collect the data, an ""Observation Guide"" was used; observation and documentary analysis. According to the results, on five contracts examined, the conclusions are: in four out of five, the object of acquisition was basic family baskets; in three, the beneficiary subjects are municipal personnel; the total economic loss amounts to S/ 598, 175.90; the transgressed norms include, the State Contracting Law and its regulations; General Law of Administrative Procedures; The Legislative Decree of the National Budget System for Fiscal Year 2020; Public Employment Framework Law. Directorial and Directive Resolutions, issued by the Ministry of Economy and Finance; Ministerial Resolution referring to the MINSA and Technical Specifications for the Acquisition of Rapid Tests for the Early Detection of Covid 19 Disease; also, The Organic Law of Municipalities; Regulations of Organization and Functions of the MPT; General Directive for the Formulation of Contracting Requirements through Selection Procedures of the Municipality of Trujillo, among others; the offenders performed functions of mayor, management, deputy management, warehouse manager; among the offending behaviors, some are by action, others by omission; the alleged responsibilities are criminal, civil and administrative; finally, the recommendations are addressed to the Public Prosecutor to initiate legal actions.
