La eficacia de las medidas de protección de la ley Nº 30364 en la realidad social de la víctima, dictadas por los juzgados especializados en violencia familiar de la Corte Superior de Justicia de La Libertad, 2020

Abstract

En el Perú, dada la necesidad para prevenir, sancionar y erradicar la violencia contra las mujeres y los integrantes del grupo familiar detallada en la ley Nº 30364 cuya publicación se realizó para la fecha 23 de noviembre de 2015. Ante ello, se presenta la tesis que tiene el siguiente problema: ¿Cuál es el nivel de eficacia de las medidas de protección de la ley Nº30364 en la realidad social de la víctima, dictadas por los juzgados especializados en violencia familiar de la Corte Superior de Justicia de La Libertad, 2020?, planteándose como objetivo general: Determinar la eficacia de las medidas de protección de la ley Nº30364 en la realidad social de la víctima, dictadas por los juzgados especializados en violencia familiar de la Corte Superior de Justicia de La Libertad, 2020. Asimismo, se tiene como hipótesis general: Que el nivel de eficacia de las medidas de protección de la ley Nº30364 en la realidad social de la víctima, dictadas por los juzgados especializados en violencia familiar de la Corte Superior de Justicia de La Libertad, 2020. Es bajo. Abarcando, el contenido de este trabajo de investigación en base a las estadísticas, las normativas, los estudios de investigación, los informes y a la doctrina. Y se aplicó el método básico-descriptivo. Donde se observa aquellos baches que aún prevalecen en el sistema de justicia peruano. Además, se consideró un enfoque cuantitativo, con el diseño de investigación, No Experimental. Al aplicar el sistema de cuartiles, se identificó como conclusión general, que el nivel de eficacia de las medidas de protección de la ley Nº30364 en la realidad social de la víctima, dictadas por los juzgados especializados en violencia familiar de la Corte Superior de Justicia de La Libertad, 2020. Resultó que para tanto para los policías, los abogados y docentes universitarios, las once medidas de protección que son parte de los objetivos específicos de este trabajo de investigación tienen un nivel de eficacia que: es alto. It is low. Covering, the content of this research work based on statistics, regulations, research studies, reports and doctrine. And the basic descriptive method was applied. Where it is observed those potholes that still prevail in the Peruvian justice system. In addition, a quantitative approach was considered, with a non-experimental research design. When applying the quartiles system, it was identified as a general conclusion that the level of effectiveness of the protection measures of the law Nº30364 in the social reality of the victim, dictated by the courts specialized in family violence of the Superior Court of Justice of La Libertad, 2020. It turned out that for police officers, lawyers and university professors, the eleven protection measures that are part of the specific objectives of this research work have a level of effectiveness that is high. However, for the victims, the level of effectiveness of the eleven protection measures presented by the law is very low
