Relación entre la jurisdicción comunal y Jurisdicción ordinaria en el marco del Pluralismo jurídico, en el distrito judicial Del Santa, durante los años 2019 -2020

Abstract

El objetivo de la investigación fue determinar la relación entre la Jurisdicción Comunal y Jurisdicción Ordinaria en el Marco del Pluralismo Jurídico, en el Distrito Judicial Del Santa, durante los años 2019 – 2020. Se estableció una metodología de tipo correlacional y de diseño no experimental, transversal, correlacional; con enfoque cuantitativo y método deductivo, inductivo, de análisis y síntesis; la población se conformó por 87 jueces ordinarios de la Corte Superior de Justicia del Santa, 93 jueces de paz y 486 ronderos del Distrito Judicial Del Santa en el año 2019 – 2020 y la muestra fueron 32 jueces ordinarios, 34 jueces de paz y 178 ronderos seleccionados por muestro no probabilístico por conveniencia. Se utilizó como técnica la encuesta y como instrumento el cuestionario para cada variable. Los resultados evidencian que en mayor proporción la jurisdicción comunal es 75,41% deficiente y respecto a la jurisdicción ordinaria es 58,61% deficiente y 41,39% regular. Al analizar la relación entre la Jurisdicción Comunal y Jurisdicción Ordinaria es 58,61% deficiente y un 24,59% indica que es regular. Concluyendo que existe relación moderada entre la Jurisdicción Comunal y Jurisdicción Ordinaria en el Marco del Pluralismo Jurídico (Rho=0,679)

The objective of the research was to determine the relationship between Communal Jurisdiction and Ordinary Jurisdiction in the Framework of Legal Pluralism, in the Del Santa Judicial District, during the years 2019 - 2020. A correlational methodology and non-experimental design was established, cross sectional, correlational; with a quantitative approach and a deductive, inductive, analysis and synthesis method; The population was made up of 87 ordinary judges of the Superior Court of Justice of Santa, 93 justices of the peace and 486 patrolmen of the Judicial District of Santa in the year 2019-2020 and the sample was 32 ordinary judges, 34 justices of the peace and 178 patrolmen selected by non-probabilistic sampling for convenience. The survey was used as a technique and the questionnaire for each variable as an instrument. The results show that in a greater proportion the communal jurisdiction is 75.41% deficient and with respect to the ordinal jurisdiction it is 58.61% deficient and 41.39% regular. When analyzing the relationship between Communal Jurisdiction and Ordinary Jurisdiction, it is 58.61% deficient and 24.59% indicates that it is regular. Concluding that there is a moderate relationship between Communal Jurisdiction and Ordinary Jurisdiction in the Framework of Legal Pluralism (Rho = 0.679)
