La regulación genérica del mandato ejecutivo de obligación de dar suma de dinero en nuestro código procesal civil y la tutela jurisdiccional efectiva

Abstract

La presente tesis se titula: “La regulación genérica del mandato ejecutivo de obligación de dar suma de dinero en nuestro código procesal civil y la tutela jurisdiccional efectiva”, en esta se ha planteado la siguiente pregunta: “¿De qué manera la regulación genérica del mandato ejecutivo de obligación de dar suma de dinero atenta contra la tutela jurisdiccional efectiva?”, formulándose como hipótesis: “la regulación genérica del mandato ejecutivo de obligación de dar suma de dinero atenta contra la tutela jurisdiccional efectiva ya que deja al ejecutante en un estado de desprotección, ya que, al no regularse un plazo determinado, sería imposible establecer cuándo se ha de materializar el apercibimiento de la ejecución forzada”. Del mismo modo nos propusimos como objetivo general: “Dar a conocer cómo es que La regulación genérica del mandato ejecutivo de obligación de dar suma de dinero atenta contra la tutela jurisdiccional efectiva”. Arribándose a la siguiente conclusión general: “No existe un plazo para el cumplimiento de pago en el mandato ejecutivo dentro del proceso ejecutivo de obligación de dar suma de dinero, lo que conlleva afirmar que existe una grave vulneración a la tutela jurisdiccional efectiva toda vez, que de esta manera no se estaría protegiendo adecuadamente a los acreedores que buscan la efectivización de su acreencia puesta a cobro; por tal razón, resulta imposible establecer cuándo se ha de materializar el apercibimiento de la ejecución forzada señalado en el mandato ejecutivo del proceso antes mencionado”

This thesis is entitled: ““The generic regulation of the executive mandate of the obligation to give a sum of money in our civil procedure code and the effective jurisdictional protection““, in this the following question has been raised: ““How does the generic regulation of the executive mandate of obligation to give sum of money violates effective jurisdictional protection?”, formulating as a hypothesis: “the generic regulation of the executive mandate of obligation to give sum of money violates effective jurisdictional protection since it leaves the executor in a state of lack of protection, since, by not regulating a specific term, it would be impossible to establish when the warning of forced execution will materialize.” In the same way, we set ourselves the general objective: ““To make known how it is that the generic regulation of the executive mandate of the obligation to give a sum of money threatens effective jurisdictional protection.““ Arriving at the following general conclusion: ““There is no term for payment compliance in the executive mandate within the executive process of obligation to give sum of money, which entails affirming that there is a serious violation of effective jurisdictional protection every time, that this would not adequately protect creditors who seek to make effective their credit placed for collection; for this reason, it is impossible to establish when the warning of forced execution indicated in the executive order of the aforementioned process will materialize
