Actuación de la Policía Nacional del Perú en las diligencias preliminares en el sistema acusatorio garantista adversarial en el distrito judicial de Trujillo 2020 - 2021

Abstract

La problemática desarrollada en la investigación está referida a determinar la actuación de la Policía Nacional del Perú en las diligencias preliminares en el Sistema Acusatorio Garantista Adversarial en el Distrito Judicial de Trujillo 2020 – 2021. La presente investigación, fue de tipo descriptivo, en cuanto al enfoque ha sido un trabajo cualitativo. El escenario de estudio ha sido el Distrito Judicial de Trujillo, ahí se realizaron entrevistas a los fiscales y policías, en lo que respecta a las técnicas de recopilación de información se empleó el análisis documental, a través de los informes de la PNP de la jurisdicción en estudio; asimismo, se realizó la entrevista a profundidad, con su respectivo instrumento la guía de entrevista. Llegando a la conclusión que, en la actuación de la Policía Nacional del Perú en las diligencias preliminares en el Sistema Acusatorio Garantista Adversarial en el Distrito Judicial de Trujillo, existe limitación con el nuevo código procesal penal. Puesto que, se enmarca dentro de la Constitución, las Leyes, Reglamentos, Protocolos y demás normas vigentes y que son materializados con la coordinación constante del representante del Ministerio Público quien en ejercicio de sus funciones conferidas debe orientar jurídicamente la investigación que realiza la Policía Nacional del Perú

The problem developed in the investigation is referred to determining the performance of the National Police of Peru in the preliminary proceedings in the Adversarial Guarantee Accusatory System in the Judicial District of Trujillo 2020 - 2021. The present investigation was of a descriptive type, in terms of the approach has been a qualitative work. The study scenario has been the Judicial District of Trujillo, there interviews were conducted with prosecutors and police officers, with regard to information collection techniques, documentary analysis was used, through the PNP reports of the jurisdiction. in study; Likewise, the in-depth interview was conducted, with its respective instrument, the interview guide. Coming to the conclusion that, in the performance of the National Police of Peru in the preliminary proceedings in the Adversarial Guarantee Accusatory System in the Judicial District of Trujillo, there is a limitation with the new criminal procedure code. Since, it is framed within the Constitution, the Laws, Regulations, Protocols and other norms in force and that are materialized with the constant coordination of the representative of the Public Ministry who, in the exercise of his conferred functions, must legally guide the investigation carried out by the National Police.
