La eutanasia y la esencia iusnaturalista del derecho a la vida

Abstract

El presente trabajo de investigación nace a consecuencia de la necesidad de entender de qué manera la eutanasia confronta la esencia iusnaturalista del derecho a la vida; ello en respuesta a la incertidumbre que persiste respecto a si habría o no una vulneración del derecho mencionado al practicarse este método, tomando en consideración lo regulado en el artículo 5º del Código Civil (irrenunciabilidad de derechos fundamentales), aunque tal cual se podrá observar en esta tesis, existen otros derechos como el libre desarrollo de la personalidad y el derecho a morir dignamente que, guiados por el atributo de la dignidad se superponen al derecho a la vida, configurándose la eutanasia como una nueva limitación. Es de añadir que, la presente tesis es una investigación de tipo aplicada y causal, con un enfoque mixto, por cuanto se valoraran datos estadísticos obtenidos de la encuesta realizada a los ciudadanos de la localidad de Trujillo, y de igual manera, la información adquirida mediante las entrevistas realizadas a profesionales del derecho, medicina, psicología y religiosos

The present research work was born as a consequence of the need to understand how euthanasia confronts the iusnaturalistic essence of the right to life; This is in response to the uncertainty that persists as to whether or not there would be a violation of the aforementioned right when this method is practiced, taking into consideration what is regulated in article 5 of the Civil Code (unrenounceability of fundamental rights), although as can be seen in this thesis, there are other rights such as the free development of personality and the right to die with dignity that, guided by the attribute of dignity, are superimposed on the right to life, configuring euthanasia as a new limitation. It should be added that this thesis is an applied and causal type of research, with a mixed approach, since statistical data obtained from the survey of the citizens of the town of Trujillo will be evaluated, as well as the information acquired through interviews with legal, medical, psychological and religious professionals
