En la actualidad cuando existe vulneración a los derechos del consumidor, este tiene la facultad
de interponer su denuncia a través de Indecopi en la cual, según sea el caso, podrá ordenar
medidas correctivas y sanciones al proveedor. Asimismo, nuestra normatividad tiene
establecido ciertos mecanismos de protección al consumidor, en virtud al artículo 65° de la
Constitución Política del Perú.
No obstante, pese a que el derecho del consumidor es un derecho protegido
constitucionalmente, no existe un mecanismo de reparación de daños en vía administrativa que
proteja integralmente al consumidor. Es decir, no existe la competencia para exigir al proveedor
que resarza plenamente la magnitud del daño que efectivamente se causó con la adquisición del
bien o servicio defectuoso.
En ese sentido, el presente trabajo tiene como objetivo principal establecer la necesidad de
incorporar un mecanismo de reparación de daños en vía administrativa, toda vez que ante
situaciones en que el consumidor se ve perjudicado por la vulneración de sus derechos como
tal, no recibe una protección integral al acudir a otra vía a solicitar indemnización.
La tesis está estructurada por capítulos, tomando en cuenta doctrina nacional de diversos
autores, los mismos que nos permitirán conocer más a fondo todo lo relacionado al derecho del
consumidor, sus principios y los derechos que tiene como tal. Además, se identificarán los
mecanismos que protegen al consumidor en la cual se demostrará que en algunas situaciones
agotar la vía administrativa es insuficiente para reparar los daños causados por el proveedor.
De igual forma, es necesario señalar que no toda vulneración de derechos del consumidor
genera daños por lo que en el último capítulo abordaremos todo lo concerniente a la
responsabilidad civil.
Finalmente se establecerá después de analizada la doctrina correspondiente que es necesaria la
incorporación de un mecanismo que proteja al consumidor de manera integral, mediante la
posibilidad que en vía administrativa se pueda solicitar una indemnización en aquellos casos
que el monto de la pretensión sea menor a 1UIT de tal manera que pueda resarcir los daños
ocasionados, previa acreditación que la vulneración de los derechos del consumidor ocasionó
daño generando menoscabo como tal. At present, when there is a violation of consumer rights, it has the power to file its complaint

However, despite the fact that consumer law is a constitutionally protected right, there is no
mechanism for repairing damages in that the consumer is fully protected. That is, there is no
competition to require the supplier to fully compensate for the magnitude of the damage that
was actually caused by the purchase of the defective good or service.
In this sense, the main objective of this paper is to establish the need to incorporate a mechanism
for repairing damages in an administrative way, since in situations in which the consumer is
harmed by the violation of his rights as such, he does not receive a Integral protection to go to
another way to claim compensation.
The thesis is structured by chapters, taking into account national doctrine of various authors,
the same that will allow us to know more thoroughly everything related to consumer law, its
principles and the rights it has as such. In addition, the mechanisms that protect the consumer
will be identified in which it will be demonstrated that in some situations the administrative
route is insufficient to repair the damages caused by the supplier. Likewise, it is necessary to
point out that not every infringement of consumer rights generates damages, so in the last
chapter we will deal with everything related to civil liability.
Finally, it will be established after analyzing the corresponding doctrine that it is necessary to
incorporate a mechanism that protects the consumer in an integral way, through the possibility
